How Can I Claim an Inheritance in Palestine While Living in the United States?

Living in the United States does not, by itself, establish or exclude an inheritance claim to property in Palestine. The first step is to identify the asset, the deceased owner, the relevant heirs, and the authority responsible for the records.

Start with the ownership and family records

Collect available title deeds, registry extracts, death certificates, succession documents, and a simple family timeline. Record different spellings of names in Arabic and English. Distinguish the person named in the property records from relatives who used or managed the property.

If several relatives have died in succession, the file may require more than one inheritance stage. Do not calculate your share from an informal family understanding alone; ask a lawyer to review the applicable succession rules and the complete chain.

Establish the heirs and transfer the recorded interest

The Palestinian Land Authority’s inheritance-transfer guidance describes transferring a deceased owner’s registered shares to heirs using the relevant succession certificate. It also addresses discrepancies in names, successive deaths, and foreign succession documents. A foreign certificate may require additional judicial review even after authentication. A U.S. probate document should therefore not be assumed sufficient for a Palestinian registry.

Registering inherited rights and giving up or transferring an heir’s share are different decisions. Before signing a renunciation, settlement, or takharuj document, obtain an explanation of what you are transferring and on what terms.

Prepare for representation from abroad

  • Identify the property’s location, registry, parcel details, and any known disputes.
  • Ask which court or authority must issue or recognize the succession documents.
  • Confirm the exact powers needed in a power of attorney before signing it in the United States.
  • Check authentication, translation, and original-document requirements with the receiving authority.
  • Agree how records, progress updates, expenses, and any settlement proposal will be reported.

For registered land, the Land Authority’s document checklist is a useful starting point. The precise file depends on the transaction and the circumstances.

Questions to resolve early

Is the property still registered in the deceased person’s name? Are other heirs identified? Has anyone already transferred, leased, or occupied it? Are there mortgages, court restrictions, or disputed documents? Give your lawyer available records rather than relying only on what relatives have reported.

The sources above concern Palestinian Land Authority procedures; the same process should not be assumed for every location, including Gaza or East Jerusalem. Representation may reduce the need for travel, but personal attendance cannot be ruled out without reviewing the case.
